The Nainital High Court on Saturday reserved its order on a plea filed by rebel Congress MLAs challenging their disqualification under anti-defection law by the Speaker.
The court will pronounce its verdict on May 9 at 10 am.
Justice UC Dhyani on Thursday posted the matter for hearing on Saturday after an urgent application was moved by the rebel MLAs Umesh Sharma, Subodh Uniyal and Shailarani Rawat.
Meanwhile, the Supreme Court on Friday ordered the floor test in Uttarakhand Assembly on May 10.
The apex court said that the nine rebel Congress MLAs who have challenged their disqualification by the Speaker in the HC, will not participate in the floor test.
“If they (disqualified MLAs) have the same status” at the time of vote of confidence, they cannot participate in the voting in the House,” the court observed.
