Supreme Court Refuses To Stay Collection Of Toll Tax On DND Flyway

The apex court has directed Allahabad High Court to decide on the plea in three months challenging collection of toll tax on DND Flyway.

The apex court had accepted a Special Leave Petition (SLP) filed by Federation of Noida Residents Welfare Associations (FONRWA) on May 9 seeking to restrain Noida Toll Bridge Company Ltd (NTBCL) from collecting toll tax on DND flyway between Delhi and Noida.

As per the plea, various clauses of the Concessionaire Agreement are totally in favour of NTBCL. The company has already earned nearly four times their total project cost, the petitioner claimed.

According to A N Dhawan, secretary general, FONRWA, residents of Noida have been cheated over DND toll tax.

FONRWA members said they are disappointed with their three year legal battle for scrapping the agreement signed between the Noida Toll Bridge Company Limited (NTBCL) and the Uttar Pradesh government, through Noida authority, in the Allahabad high court.
