Reacting on the alleged irregularities in the recently held Haryana Rajya Sabha polls, former Election Commissioner Shahabuddin Yaqoob Quraishi on Wednesday said that the Election Commission has the power to cancel the elections.

In an exclusive interview to News World India, the former election commissioner said that its a ‘balatant fraud’ and that if the accusations are proved, the election commission will decide on a date of hearing.

Quraishi said that the Election Commission has experienced people and if the acquisitions are proven, EC will act accordingly.

While recommending replacing pen with a stamp to avoid such incidents in future, he said that EC can cancel the elections under Article 324.

“Normaly, role of EC ends with the declaration of results and the discrepencies are taken up with the judiciary. However, under extre circumstances the EC
has been endowed with the power to cancel the elections under Article 324 of the Indian constitution,” he said.

BJP-backed independent candidate and media baron Subhash Chandra was recently elected to the Rajya Sabha from Haryana, after 14 Congress votes were declared invalid.

The 14 votes which disqualified was on the ground that they were inked using the wrong pen. INLD and Independent candidate R K Anand said that it was BJP-RSS’s conspiracy.
